NOTIFICATION

No. 5/58/2002/IIB/1506 :  Whereas, with a view to facilitate the development of Industry in the State, Government of Punjab have notified the “Industrial Policy – 2003” vide No. 5/58/2002/IIB/968 dated 26.3.2003, which inter-alias provides for Certification of Weights & Measures under the Weights & Measures (Enforcement) Act, 1985 by Chartered Engineers.

Now, therefore, to implement the scheme of Certification of Weights & Measures under the Weights & Measures (Enforcement) Act, 1985 by Chartered Engineers, set out in the aforesaid policy, the Governor of Punjab is pleased to notify detailed scheme as under:-


1.    INTRODUCTION

The State Government has introduced a scheme of certification for verification and stamping of weights and measures under the Standards of Weights & Measures (Enforcement) Act 1985 by conferring powers of inspectors under section-5 (1) of the said Act to the Chartered Engineers possessing requisite qualifications, who shall exercise such powers and discharge such functions of Inspectors conferred or imposed on them by or under this Act in accordance with this scheme.

2.   SCOPE

This scheme will be applicable on Industrial units having weights or measures in their possession which are duly registered with the Controller Weights & Measures and in circumstances indicating that such weights or measures are being or intended or are likely to be used by them for industrial production. However, such Industrial Units will have option to get the weights and measures verified and stamped from the Chartered Engineers or Inspectors of Weights and Measures Department, Punjab in accordance with their preference.

 3.  QUALIFICATIONS OF CHARTERED ENGINEER


The Chartered Engineers to be authorised under this scheme shall have the following qualifications:-

        *    Degree in Engineering from a recognised university.

        *    He should be registered with Indian Institution of Engineers. 

         *   He should be of sound mind and of good physical health.

 

4.    PROCEDURE FOR AUTHORISATION OF CHARTERED ENGINEER

(i)     Chartered Engineers fulfilling the qualification as per Clause-3 above and desirous of discharging such functions may apply in response to an advertisement to the Controller Weights & Measures, Punjab in Format WM-I along with documents listed therein.

(ii)     A seniority list in terms of qualifications and experience from the complete applications received above will be prepared by the office of Controller, Weights & Measures. Controller, Weights & Measures, Punjab, shall issue letter of authorisation in Format WM-II on the basis of above seniority list to 34 Chartered Engineers.   However, the number of Chartered Engineers can be increased / decreased by Principal Secretary, Industries & Commerce.

(iii)   In case of any irregularity, authorisation of Chartered Engineer shall be terminated by Controller Weights & Measures, Punjab.

 

5.    STATUS

The Chartered Engineers will be authorised to exercise powers and discharge duties in accordance with Section 5 of the Act.

6.    TRAINING

Every Chartered Engineer so authorised shall have to successfully complete a two weeks basic training course to be arranged by the Controller Weights & Measures.

7.     JURISDICTION

The Chartered Engineers shall operate within the State of Punjab.

8.     DUTIES OF CHARTERED ENGINEERS

VERIFICATION AND STAMPING OF WEIGHTS AND MEASURES

 

(i)    Periodicity:

(a)  Every weight or measure used or intended to be used for industrial production shall be verified or reverified and stamped by the Chartered Engineer once in a year, provided that storage tanks including vats shall be reverified or recalibrated and stamped at least once in a period of five years.

(b)Notwithstanding anything contained above, every weight or measure which has been verified and stamped in situ, shall, if it is dismantled and reinstalled before the date on which the verification falls due, be duly reverified and stamped on payment of fee as prescribed under the Rule-17 of Punjab Standards of Weights & Measures (Enforcement) (Amendment) Rules 1999, before being put into use.


(c)
 Notwithstanding anything contained above, every weight or measure which has been verified and stamped, if it is repaired before the date on which the verification falls due, shall be duly reverified and stamped on payment of fees as prescribed under Rule-17 of Punjab Standards of Weights & Measures (Enforcement) (Amendment) Rules 1999, before being put into use.

(ii)     Procedure:
(a) The Chartered Engineer shall maintain a place designated as his office from where he shall conduct his work, which shall be mentioned in his application and letter of authorisation.

(b)   For the purpose of verification and stamping every unit using or manufacturing weight or measure shall present such weight or measure for verification or reverification, as the case may be, at the office of the Chartered Engineer, or at such other place as the latter may specify in this behalf on or before the date on which the verification falls due.


(c)
   Provided that where any weight or measure is such that it cannot, or should not be moved from its location, the unit using or manufacturing such weight or measure shall report to the Chartered Engineer at least 30 days in advance from the date on which the verification falls due.


(d)
   Where any weight or measure is such that it cannot or should not be moved from its location, the Chartered Engineer shall take necessary steps for the verification of such weight or measure at the place of its location.


(e)
   For the verification of weight or measure referred to above the user or manufacturer shall provide such reasonable facilities as may be required by the Chartered Engineer.


(f)
   Every weight or measure presented for verification shall be complete in itself  and shall not bear a manufacturer’s mark, which might be mistaken for verification stamp.

(g) Every weight or measure shall be verified in a clean condition, if necessary, the Chartered Engineer shall require the user or manufacturer unit as the case may be, to make necessary arrangement for the purpose.

(h)  Where a weight or measure is brought to the chartered engineer for verification or reverification, he shall verify the same after realisation of the prescribed fee.


(iii)
    Stamping:


The Chartered Engineer shall stamp every weight or measure, if after verification, he is satisfied that such weight or measure conforms to the standards established under the Standards Act, with a stamp of uniform design issued by the Controller against payment, which shall indicate the number allotted for administrative purposes to the Chartered Engineer by whom it is stamped.

 

The Chartered Engineer shall also mark the year and its quarter of stamping on every verified weight or measure.

 

(iv)   Issue of Certificate

On completion of verification and stamping the Chartered Engineer shall issue a certificate of verification in the form as set out at Annexure-I based on schedule-13 of Punjab Standards of Weights & Measures (Enforcement) Rules 1993, to the unit and send a copy of the same to the Assistant Controller Weights & Measures of the concerned area.

The copy of the user shall be treated as certificate of verification to be prominently displayed in the premises of the unit in accordance with procedure laid down in Rule-23 of Punjab Standards of Weights & Measures (Enforcement) Rule-1993

 

(v)    Fee for Verification and Stamping

(a)  Fees payable for verification and stamping of weights or measures at the camp office of the Chartered Engineer shall be as specified in schedule-XIV of Punjab Standards of Weights & Measures (Enforcement) (Amendment) Rules 1999, (Annexure-III).

(b)  If, at the request of user or manufacturer of weight or measure, verification is done at any premises other than in office or camp office of the Chartered Engineer, an additional fees of Rs. 200 shall be charged from the user / manufacturer of weights or measures.

Provided that no additional fee shall be charged for verification and stamping in situ of

-           Vehicle tanks, weigh-bridges, dormant platform machines and such other weight or measure which cannot and should not be moved from its location and

-           Weights or measure in the premises of the manufacturer of such weights or measure.

 

(c)  If a weight or measure is presented to the Chartered Engineer for reverification after the expiry of period of validity of stamp, an additional fee at half the rates specified in Schedule-XIV Punjab Standards of Weights & Measures (Enforcement) (Amendment) Rules 1999, shall be payable for every quarter of year or part thereof.

(d)  No fee shall be payable for restamping any weight or measure held in stock with the manufacturer within a period specified in the Rule-14 Punjab Standards of Weights & Measures (Enforcement) Rules 1993 from the date on which it was last stamped.

Provided that original stamp was not obliterated under sub-section-3 of section-28 of Punjab Standards of Weights & Measures (Enforcement) Act 1985.

(e)  A weight or measure which on verification is found to be incorrect shall be returned to the person concerned for adjustment informing him, in a Performa as at Annexure-II, of the defects found in the weight or measure and calling upon him to remove the defects within a period not exceeding 7 days and when the necessary adjustment has been carried out, such weight or measure shall be verified on payment of 50% of the fees specified in Schedule-XIV of Punjab Standards of Weights & Measures (Enforcement)(Amendment) Rules 1999, and if found correct, shall be stamped.
(f)    As per Rule-6 of Standards of Weights & Measures (Inter State Verification & Stamping) Rule 1987;

(i)   The fee for verification of any weights or any measures of the first category as specified in Rule-3 of the above Rules and stamping of weight or measure with the special seal shall be levied by the Government of the transferor State at the rate leviable in that State for verification and stamping of the same or similar weight or measure plus an additional fee of 25% of the fee aforesaid.
(ii)  The fee for the verification of any weight or measure of the second category as specified in Rule-3 of the above Rules and stamping thereof shall be levied by the Government of the transferee State at the rate leviable in that State for the verification and stamping of the same or similar weight or measure plus an additional fee of 25% of the fee aforesaid.
(vi)
Collection of fees and deposit into treasury

(a)  Before commencing the work of verification or reverification, the Chartered Engineer shall inform the unit concerned of the fees payable by the unit as prescribed above and shall receive the same in cash and issue a receipt in the form as placed at Annexure IV.

(b)   The Chartered Engineer shall maintain a register, in the form as at Annexure V which shall be written on day-today basis and shall show the amount of fees and other charges collected during the day.
(c) The Chartered Engineer shall deposit the prescribed fees charged for verification and stamping during the fortnight with the Assistant Controller of the Division on fortnightly basis on every alternate Monday alongwith details of fee collected in form at Annexure VI. Details of transportation expenditure charged, if any, shall also be submitted in the Form. 
(d)    The Chartered Engineer shall submit a monthly progress report to the Controller regarding verification and stamping etc. before 5th of every month in a Form (Annexure VII) with a copy to concerned Assistant Controller.

9. COMPLIANCE OF ACTS AND RULES
The Chartered Engineer shall meticulously comply with the Standards of Weights & Measures Act, 1976, the standards of Weights and Measures (Enforcement) Act 1985 and the Rules framed there under. 
10.  SERVICE CHARGES

The Chartered Engineer shall charge service charges of Rs. 200 per visit for verification and stampings of Weights & Measures, from the unit. He shall issue a receipt of these (including any fees charged under Para 8 (v) (b) to the user, separately, in Annexure-VIII.
11. PROVISION OF WORKING STANDARDS, EQUIPMENTS ETC. TO CHARTERED ENGINEERS

 (a)   Every Chartered Engineer shall be provided with working standards, working standard balances and such other equipment including weighing an measuring devices as may be approved by the Controller against payment.

 

(b) Every Chartered Engineer shall be provided such dies, punches and such other equipment against payment as may be necessary for fixing verification stamp.

 

(c)   Every die and punch provided to the Chartered Engineer shall be allotted a specific code or administrative number.

 

(d)   Every Chartered Engineer shall be provided with punches of suitable sizes of eight-  pointed star for obliterating stamps, against payment.

12.  RANDOM CHECKING 

A Committee under the Chairmanship of Director of Industries & Commerce, Punjab and comprising of General Manager, District Industries Centre, Controller Weights & Measures and two Representatives of local Industry Association can order random checking (through computerised randomisation) upto 5% of units in each district by an officer, not posted in that district and chosen randomly. In case of defaults, the Chartered Engineer be liable to face action as mentioned in Section 5 of the Act and the unit will be liable to be penalised as per penal clauses defined under Chapter XI of the Act.

13.   WILFUL VERIFICATION OR DISCLOSURE IN CONTRAVENTION OF LAW

(i)  If any Chartered Engineer exercising powers under the said Act or any rule made there under wilfully verifies or stamps any weight or measure in contravention of the provisions of the Act or of any rule made there under, he shall be liable for action under section 57 (1) of the Act.

(ii) If any Chartered Engineer who enters into any premises in the courses of his duty wilfully discloses except in the performance of such duty, any information obtained by him from such premises with regard to any trade secret or any secret in relation to any manufacturing process, he shall be liable for action under section 57 (2) of the Act.

(iii)The Chartered Engineers under the scheme shall be liable for all acts of omission and commission, as an Inspector is under the provisions of the relevant Act / Rules & Regulations.

14.
   OVERRIDING EFFECT

The Standards Weights & Measures (Enforcement) Act 1985 and Rules and Regulations framed there under shall have an overriding effect on the provisions of this scheme.

15.  INTERPRETATION / RELAXATION / AMENDMENT OF RULES


Principal Secretary, Industries & Commerce shall be competent to interpret / relax / amend provisions of this scheme.
